  1. Scope and Object of the General Store Conditions

1.1 These General Conditions are intended, together with the order form, and the other elements referred to therein, to regulate the terms and conditions that will govern the provision of the Online Store Service of Fernando Rodrigues Ferreira Unipessoal, Lda, with registered office at Av. de São Lourenço 54, Celeirós, 4705-442 Braga, under the unique registration and identification number of legal person nº 509570720, with share capital of 10,000.00 (euros), hereinafter referred to as Garrafeira Grande Escolha.

1.2 The service consists of providing, through the address https://garrafeiragrandeescolha.pt, access to the Online Store which, in addition to providing information relating to a set of products and/or services, allows the user, electronically, to order the products disclosed therein, under the terms and conditions described here.

1.3 The purchase of any product in the Garrafeira Grande Escolha Online Store implies acceptance of these General Online Sales Conditions.

1.4 Any and all alcoholic drinks available for sale in the Garrafeira Grande Escolha Online Store can only be purchased by people who are of legal age to do so, in their country of residence. The elements and information transmitted by the user will enjoy full legal effects, with the user recognizing electronic purchases, and the user will not be able to claim the lack of signature for non-compliance with the obligations assumed.

  1. Product Information, Prices and Contents

2.1 Garrafeira Grande Escolha reserves the right to modify, without prior notice and at any time, the information and commercial offer presented regarding: products, prices, promotions, commercial conditions and services.

2.2 The images that illustrate each product at Garrafeira Grande Escolha may differ from the product subsequently delivered, and these same products are also subject to stock outs. If a product is not available after placing the order, you will be notified by email or telephone. At that moment you will be presented with the possibility of canceling the order with a corresponding refund, if you have already made the respective payment.

2.3 Garrafeira Grande Escolha will do everything possible to ensure that the information presented does not contain typographical errors, which will be quickly corrected whenever these occur. If you purchase a product that has characteristics different from those presented online, you have the right to terminate the purchase contract under the applicable legal terms (right of free resolution).

2.4 Under Portuguese legislation, all prices presented at Garrafeira Grande Escolha include the respective VAT rates in force, unless otherwise indicated.

2.5 Promotions advertised at Garrafeira Grande Escolha may not be applicable to the physical store at Av. de São Lourenço 54, Celeirós in Braga.

  1. Order and Payment

3.1 After confirming the order at Garrafeira Grande Escolha, an email will be sent to the contact address registered there by the customer when formalizing, with all details about delivery, invoicing, payment information, products and values. Garrafeira Grande Escolha suggests all customers confirm their details. If the customer does not receive the order confirmation email, they are asked to contact Garrafeira Grande Escolha.

3.2 If any of the details placed by the customer in the order are incorrect and/or the customer wishes to change any information, as long as the order has not yet been shipped, the customer is requested to get in touch as soon as possible so that it can be internally made the change requested by the customer. Changes to the details of orders already shipped will have to be analyzed by the Garrafeira Grande Escolha team so that, together with the customer, the most appropriate solution can be found.

3.3 All orders at Garrafeira Grande Escolha will only be processed after effective receipt of payment. The formalization of the order alone does not constitute a reservation of the products.

3.4 If an order cannot be fulfilled in part or in full, the customer will be immediately contacted by Garrafeira Grande Escolha in order to find the most appropriate solution.

3.5 All orders placed at Garrafeira Grande Escolha have a maximum payment period of 15 days. After this period, the order will be automatically cancelled.

3.6 Through the Garrafeira Grande Escolha Online Store, payments are accepted via Multibanco Reference and MBWay (for customers with a bank account in Portugal), Credit Card and Paypal.

3.7 Order statuses at Garrafeira Grande Escolha are comprised of 3 phases: Pending, In Processing and Completed.

a) Pending – Waiting for payment to enter the system;
b) In Processing – Phase in which payment has already been received, and the order is in processing and packaging/preparation;
c) On Hold – Waiting for additional confirmations with the customer to proceed with the order. Exceptional phase.
d) Completed – The order has already been dispatched/shipped.

3.8 Payments are received in euros, regardless of the currency in which the transaction is carried out, the conversion rates for payments made in other currencies will have to be borne by the customer.

  1. Shipping costs

4.1 The respective shipping costs are added to the prices shown on the products for each order, which depends on the weight of the order and the respective delivery destination. This shipping value can be simulated within the shopping cart with the desired products added and filling in all the requested fields in the simulator. The total shipping costs will also be automatically calculated when placing your order in the Online Store. Please note that the factors in this calculation may be variable and may undergo changes without prior notice.

  1. Shipments and Deliveries/Collection in a Physical Store Garrafeira Grande Escolha

5.1 For orders to be sent to the requested address, the shipping option must be chosen – National Shipping (in the case of Portugal) and International Shipping (in the case of other countries outside Portugal).

5.2 In general, after dispatch, an order at Garrafeira Grande Escolha takes a while to be delivered:

– 72 hours in mainland Portugal;
– Between 5 and 9 working days on the Islands of Madeira and Azores;
– Around 4 working days in Peninsular Spain;
– Around 6 to 9 working days in the rest of Europe;
– Approximately 7 business days in the rest of the world.

5.3 All products sent by Garrafeira Grande Escolha must be checked upon delivery. If the customer finds that the order is damaged, they must immediately return it to the transport company, duly justify the reason for the return on the carrier's delivery note and immediately notify Garrafeira Grande Escolha.

5.4 If, after delivery, the customer finds that any of the items are not in conformity, they are requested to immediately contact Garrafeira Grande Escolha via email info@garrafeiragrandeescolha.pt indicating the order number or the number of the document that accompanied the order, attaching images of the packaging as received and of all items, so that the process of investigating the occurrence can be opened internally and in this way the situation can be resolved as quickly as possible. as quickly as possible.

5.5 Garrafeira Grande Escolha is not responsible for shipments made to countries where the respective law does not allow the entry of alcoholic beverages. It is the customers' responsibility to seize their orders, as well as pay customs fees, if applicable. If products are returned, Garrafeira Grande Escolha will only refund the amount corresponding to these same products. 5.6 Garrafeira Grande Escolha has contracted services with specialized carriers for the purpose of deliveries in Portugal, Europe and most countries in the world. Every effort is made to meet shipping and delivery deadlines, however, it should be noted that possible delays in deliveries may be of a nature beyond Garrafeira Grande Escolha, and it is not possible, in these cases, to guarantee exact delivery deadlines.

5.7 Most deliveries are made during office hours on working days to the shipping address indicated by the customer when submitting the order.

5.8 If delivery attempts by the transport company are unsuccessful due to absence, a delivery notice is always left in the customer's mailbox with the carrier's details. Depending on the service and the carrier, orders must be collected at the location indicated by the carrier in the transit notice, or the instructions requested in the same notice must be followed.

5.9 Before submitting the order, if the customer wishes to collect it from the physical store, they must select the shipping option ''Collection in Store'' - the Store at Av. de São Lourenço 54, Celeirós in Braga will automatically be assumed.

a) Only the person whose name is described in the order form will be authorized to collect the order, unless they inform Garrafeira Grande Escolha in advance that another person (identifying their name) will collect the order.

  1. Shipments and Deliveries/Collection

6.1 Garrafeira Grande Escolha recognizes that all its customers have the right to terminate the contracts they sign with it, allowing them to return it, within a period of 14 days counting from the day on which the consumer acquires physical possession of the good, the products acquired under the terms of Decree-Law no. 143/2001 and Decree-Law 82/2008 of 20/05.

6.2 For exchanges or returns, the customer is asked to contact Garrafeira Grande Escolha via email info@garrafeiragrandeescolha.pt indicating the number of the order or the document that accompanied it, taking into account the conditions described below in the following topics:

a) To return the order, the product must be in perfect condition, and where appropriate with its original packaging, accessories or promotional offers included, and accompanied by proof of purchase or invoice.

b) The return of defective products and incorrect shipments will be permitted, with Garrafeira Grande Escolha being responsible for shipping and collection costs whenever the customer communicates this circumstance within 14 days from the date of receipt of the product.

c) Once the merchandise has been received at our facilities and after validating its condition accordingly, the value will be returned in accordance with the payment method made by the customer, or another solution previously agreed with the customer. .

d) If the return is not due to a defect or incorrect shipping, the respective shipping costs will be the responsibility of the customer.

6.3 Garrafeira Grande Escolha assumes responsibility arising from defects in the origin or raw material of the product purchased and if this is confirmed by the Garrafeira Grande Escolha specialized team, the product will be exchanged or returned at no cost to the client.

6.4 Garrafeira Grande Escolha will not accept the return of the product after it has been used, or if it has been altered or modified.

6.5 Garrafeira Grande Escolha is not responsible for deficiencies arising from incorrect use, negligence, poor storage conditions or causes of force majeure.

  1. Responsibility

7.1 All purchases made on the Garrafeira Grande Escolha website are subject to Portuguese legislation. Any conflict or divergence of interpretation of the General Conditions of Online Sale will be submitted to the competent Portuguese Court.

7.2 If the Customer is located outside mainland Portugal, Garrafeira Grande Escolha informs in advance that any legal proceedings must be exclusively initiated in the Portuguese Courts.

  1. Privacy and Protection of Personal Data

8.1. Garrafeira Grande Escolha guarantees the confidentiality of all data provided by Users.

8.2. The personal data identified on the order form as being mandatory to provide are essential for the provision of the Service by Garrafeira Grande Escolha. The omission or inaccuracy of the data provided by the User is their sole and entire responsibility and may result in Garrafeira Grande Escolha refusing to provide the Service.

8.3. The User's personal data will be processed and stored electronically and are intended to be used by Garrafeira Grande Escolha within the scope of the contractual and/or commercial relationship with the User.

8.4. In accordance with applicable legislation, the User is guaranteed, without additional charges, the right to access, rectify and update their personal data, directly or upon written request, as well as the right to object to their use for the purposes set out in the previous number, and for this purpose you must contact the entity responsible for processing personal data: Garrafeira Grande Escolha.

8.5.
